Questions any idiot can answer

A busy yard in a distribution depot, one day a worker is crushed by a 44 tonne articulated HGV. The HSE inspector turns up, which is the first question he asks…

    Why wasn’t the worker wearing a helmet?
    Why weren’t pedestrians segregated from vehicles by a barrier?

A busy yard at a distribution depot, the sun is low in the winter sky, an HGV driver pulls on to the yard, the sun is straight in front of him, he can’t see where he is going, he runs over and kills a pedestrian. The HSE inspector turns up, which is the first question he asks…

    Why didn’t the driver have sunglasses, a clean windscreen or stop until he could see where he was going?
    Why was the pedestrian listening to an MP3 player?

Questions nobody can answer.
Why do we apply such an appallingly low duty of care to anyone operating a dangerous machine in a public space?

  1. If the worker is hit by a 44 tonne articulated HGV is a plastic hat going to make a difference? Something that is designed to protect against a brick dropped from 2 m, protecting against a 44 tonne vehicle?

    As for the pedestrian, they were in a public space, why shouldn’t they listen to a an MP3 player? They were not posing a risk to others be doing so.

    Was the driver digging out the delivery paper work more likely…
